Fenix Diesel Lab Limited Warranty

By contracting our services you agree to and accept the terms and conditions of this limited warranty,

What does this warranty cover?

This limited warranty covers defects in the manufacture and/or materials utilized in our injector / pump servicing and rebuilding process. 

 

What does this warranty not cover?

This limited warranty does not cover losses or damages due to:

            Improper installation

            Improper calibration

            Tampering or disassembly

            Performance modifications

            Vehicle modifications such as emissions deletes, defeats, and tuning.

            Physical damage or failure due to fuel contamination.

What is the coverage period?

All remanufactured or serviced injectors and pumps carry a 12 month limited warranty from the date of service.  Coverage is valid only for the original customer and is not transferable.

 

What will we do to if a warranty on our service is claimed?

If during the warranty period a failure occurs (not as a result of our warranty exclusions above) as determined by our testing, Fenix Diesel Lab, at its option, will repair or replace the defecting or malfunctioning component or item at no charge.  The customer must ship or deliver the item or items at their expense to us for testing and warranty consideration.  If our testing confirms that any item does not exhibit any manufacturing defect within normal operating parameters, the customer will be assessed a fee for cleaning/testing and the item will be sent back to you at your expense or will need to picked up by you in a timely fashion.   Any item left over 30 days upon completion of testing days will be sold for parts and labor.   

 

What will we not do?

NO refunds, exchanges or returns are given on products sent to us under a warranty claim.  We do not offer refunds, exchanges or returns on items that have been installed.  Fenix Diesel Lab assumes no liability for the improper installation, improper product selection or misapplication of our items or service. The customer is responsible for having the installer complete a proper installation and calibration as required.  Under no circumstances will Fenix Diesel Lab be liable for any expenses the customer may incur related to the items sold / received from us.  This includes, but is not limited to, labor or installation charges, down time, towing, travel, lodging or other expenses incurred in the diagnosis of any claimed defect (such as third party testing), removal or reinstallation of the product or any other contingent expense that may be incurred.

The items and services are provided on an “AS IS” with all faults basis and with no warranty except the limited warranty set forth in this document. 


What would void this limited warranty?

Misuse, tampering or disassembly of any part will void your warranty immediately. 

 

How is service provided?

All warranty claims are subject to prior approval by Fenix Diesel Lab.  Warranty claims can be made in person at our location or by contacting us at fenixdieselnick@gmail.com.  A warranty Claim Request Form will be provided and must be completed and returned to us before any warranty claim can be initiated.   Once the Warranty Claim Request Forms is received, an RMA number will be provided along with written instructions on shipping the items for evaluation.  No items will be accepted without a completed Warranty Claim Request Form.   Shipping to our laboratory is at the customer’s expense.  Responsibility for the return shipping costs is dependent upon the results of our testing. 

We do not voluntarily store indefinitely any items sent to us for testing.  The original customer for the items will be responsible to communicate with us regarding the results of the testing and to pay any testing fees owed to us.  We will hold warranty claim items for 30 calendar days from the date of testing and will utilize reasonable efforts to communicate with the customer, using the phone number / emails found on the Warranty Claim Request Form or given to us during the original transaction, regarding the testing results and any fees owed.  If we do not hear from the customer and /or any applicable fees remain unpaid after the 30 day storage period, we will deem all of the items sent to us intentionally abandoned and will dispose of, use, reuse and/or sell the abandoned items at our discretion. 

 

Is there a limit to damages claimed?

Under no circumstances shall Fenix Diesel Lab, its directors, shareholders, officers, agents, employees, contractors, successors or assigns be liable for any injuries or damages whatsoever to any person or property arising from the installation or use of the Products, which shall include, but not be limited to, consequential, incidental, special, exemplary or punitive damages. To the maximum extent permissible by law, Fenix Diesel Lab’s liability in all events is limited to, and shall not exceed, the purchase price paid for any Product / service that gives rise to any liability. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Entire Agreement
The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Fenix Diesel Lab.  Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of Fenix Diesel Lab.
